These Terms of Service ("Terms") govern your use of the software product ("Product") provided by Cursorful ("Provider"). By accessing or using the Product, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Product.
Subject to your compliance with these Terms, Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Product for your personal or internal business purposes.
You may not sublicense, distribute, modify, reverse engineer, decompile, or create derivative works of the Product, or any part thereof, without the prior written consent of Provider.
Each license entitles you to a fixed number of users ("seats"), and each seat to a limited number of activations — the browser profiles and desktop installations registered to your license. Your specific limits are determined by the plan you purchased and are shown in your account. A license also permits a limited number of deactivations within a rolling period so seats can be moved between devices.
You agree not to exceed, share beyond, or attempt to circumvent the seat, activation, or deactivation limits of your license (for example, by sharing a license key or credentials so that more users or devices use the Product than your license permits). Provider may enforce these limits, including by refusing further activations or suspending a license that is used in excess of, or in violation of, these limits.
Provider may release updates, upgrades, or new versions of the Product from time to time. Your continued use of the Product is subject to your acceptance of any such updates or upgrades.
Provider retains all rights, title, and interest in and to the Product, including all intellectual property rights. These Terms do not grant you any ownership or intellectual property rights in the Product.
If you provide any feedback, suggestions, or ideas regarding the Product, you grant Provider a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback into the Product.
You may need to create an account to access and use the Product. You are responsible for maintaining the confidentiality of your account credentials and for any actions taken using your account.
You agree to use the Product in compliance with all applicable laws, regulations, and third-party rights.
You must not use the Product to engage in any illegal, unauthorized, or harmful activities, including but not limited to transmitting malware, spamming, infringing intellectual property rights, or creating, storing, or sharing illegal or explicit content as described in Section 4.
The Product lets you upload recordings and share them through public or organization-restricted links (the "Shared Videos" feature). The following terms apply whenever you upload, host, or share content using this feature.
You are solely responsible for the videos and other content you upload or share. You represent that you have all rights necessary to upload and share that content, and that doing so does not violate any law or the rights of any third party.
You must not upload, host, or share, through the Shared Videos feature or otherwise, any content that:
To keep the Shared Videos feature safe, Provider uses automated and manual moderation. When a video finishes uploading, it may be automatically screened by an automated explicit-content (NSFW) detector. Videos that are reported by viewers may be subject to additional, more thorough automated and human review. These checks are provided on a best-effort basis and Provider does not warrant that all prohibited content will be detected.
If content is found, or is reasonably suspected, to violate these Terms, Provider may, at its sole discretion and without prior notice, disable, restrict, or remove that content, and may suspend or terminate the responsible license. A disabled video is blocked from playback; it may be retained for a period of time for moderation, security, and legal purposes rather than deleted immediately, and a viewer attempting to watch it will be shown that it has been disabled for violating these Terms.
Each shared video includes a "Report this video" option. If you believe a video violates these Terms, please report it; reports are sent to Provider for review. Submitting knowingly false or abusive reports is itself a violation of these Terms.
Provider may collect and use certain data and information in connection with your use of the Product.
You retain ownership of any data or information you provide or upload to the Product. By using the Product, you grant Provider a non-exclusive, worldwide, royalty-free license to use, reproduce, and modify such data for the purpose of providing and improving the Product.
The Product is provided on an "as is" and "as available" basis, without any warranties or conditions, express or implied. Provider disclaims all warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Provider shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Product, even if advised of the possibility of such damages.
Provider does not warrant that its moderation, including automated explicit-content detection and report review, will identify or remove all prohibited content, and Provider is not liable for content uploaded or shared by users in violation of these Terms.
You may terminate these Terms at any time by ceasing to use the Product and uninstalling any copies of the Product from your devices.
Provider may suspend or terminate your access to the Product immediately, without prior notice, if you breach these Terms or engage in any unauthorized or prohibited activities.
